| | | Pre-action protocols: defamationPre-action protocols have been introduced in order to establish clear standards for parties preparing to bring a court action. They are intended to improve communication between the two sides and, if possible, allow cases to be resolved without going to court.
When bringing an action for defamation it is important to act quickly, as you will usually be seeking an immediate correction and apology. At Baehrs we comply with the following pre-action protocol for defamation. - At the earliest opportunity, we will write to the maker of the defamatory statement on your behalf. Our letter will include the details of the publication or broadcast complained about, the date of publication, an outline of the inaccuracies in the material and the nature of the remedy expected.
- The defendant should reply to the claim letter as soon as possible. Their response must indicate whether the claim is accepted or not.
- If the claim is wholly or partly accepted, the defendant should indicate which remedies are to be offered.
- Alternatively, the defendant may request more information to help deal with the claim.
- If rejecting the claim, the defendant must explain why and outline any supporting facts.
At this point we will discuss with you whether it is better to settle the claim or take the matter to court.
Alternative dispute resolution
The court will expect both parties to show that alternatives to litigation, such as mediation or arbitration, were considered. Baehrs will be happy to explain all the available options to you.
