What do I need to do to begin divorce proceedings?
In order to obtain a divorce, you need to prove that your marriage has irretrievably broken down. This is the only ground for divorce in the UK. How can I prove that my marriage has irretrievably broken down?
There are several reasons that this may have happened and you will need to provide evidence of one of these. They are:
- the adultery of your spouse
- the unreasonable behaviour of your spouse
- desertion for at least two years
- separation for two years (with consent to the divorce)
- separation for five years

Is there any reason I cannot file for divorce?
You must have been married for at least one year before you can start divorce proceedings. In addition to this, either you or your spouse must have been resident in the UK for at least a year.
Is there anything else I should know?
Divorce doesn’t have to involve lengthy and complicated court action. Mediation is often the best way to sort out arrangements regarding your children and finances. It gives you and your spouse an opportunity to discuss these issues in a neutral environment with a professional on-hand to guide you through the process.
